What is an Intent-to-Use Application?

An intent-to-use application (Section 1(b) application) is a trademark application submitted to the United States Patent and Trademark Office (USPTO) that declares that the applicant has a bona fide intent to use the trademark in the United States and that the trademark is currently not being used in commerce.
